What are some examples of damages in a Massachusetts injury case?

Other than damages for pain and suffering, there are a variety of other things that may constitute damages under the law. In an injury case that isn't your fault, any factor negatively impacting your life may be considered.

Some Examples:

• The case of the bridesmaid: I had a woman client with a back injury resulting from a car accident that was not her fault. Shortly thereafter she was to be a bridesmaid in her daughter's wedding party, but unfortunately she still needed to wear a back brace due to the severity of her injuries. She was forced to suffer the discomfort and embarrassment of wearing the back brace over her bridesmaid's gown. I made sure this fact was documented and used in my damage claims against the person who hit her.

• The case of the lost spring break: I represented a young woman who was in college. Due to her injuries in an auto accident, she was forced to miss her spring break vacation trip. Since the accident was clearly not her fault, and missing a vacation can be a traumatic event for a hard working, stressed out college student, I was able to significantly increase the damage award in her settlement.
