How long after my Massachusetts auto accident can I expect it
will take to get a settlement?
How quickly you Massachusetts Auto Accident case is settled really depends on the length of your treatment, since we
generally don't put in a claim
until all your treatment is complete. This is known as a "medical end
result". That way, we have the complete accounting
of the costs of your medical treatment without guessing or estimating. That's
the only way to make sure you are fully compensated for all of your medical
bills.
From there, it depends on a lot of administrative
factors, and whether they are willing to settle or we need to sue them in court.
I will send the insurance company a demand package, which will contain a
description of the events and liability, and all the documentation of your
medical bills and lost wages. They have 30 days to respond to the demand
package. They can deny liability, or offer a counter settlement. If we can't
agree on a settlement, then I will file a lawsuit.
Generally, the quickest these things get resolved is 6 months from the time of
your accident, if your medical recovery time is not too extensive and if it is a
relatively simple case that the insurance company is willing to settle. For
more complicated and serious cases, and if the insurance company isn't being
reasonable and we have to take them to court, it can be a year or more before
your case is finally settled.
However, there are some exceptions to these rules. For example, in cases
where you have a lost wages claim from a job you were unable to
work due to your injuries - often we can get your wages compensation covered
up front, so you don't have to struggle paying your day to day bills.
